Terms of Use

These terms cover your use of the Twirl: Questions & Party Game app ("Twirl" or "the app") and the website twirlcards.com. Twirl is run by Nomad Tracker LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States ("we", "us"). By downloading or using Twirl you agree to these terms and to ourPrivacy Policy. If you do not agree, please do not use the app.

1. Who can use Twirl

Twirl is rated 16+ on the App Store. Some decks contain flirty and mature themes, so you must meet that age rating to use the app. Each deck shows who it is meant for; please choose decks that suit the people you play with.

2. Play nice

Twirl is a conversation game. Every question and dare is optional: anyone can skip a card, for any reason, and nobody should be pressured to answer or do something they are not comfortable with. Use common sense with dares. Do not do anything unsafe, illegal or without the consent of everyone involved. You are responsible for how you and the people you play with use the app.

3. Your license to use Twirl

We give you a personal, non exclusive, non transferable license to use Twirl on Apple devices you own or control, for your own non commercial entertainment. The app, its decks, questions, artwork, mascot, name and logo belong to us and are protected by copyright and trademark law. Please do not copy, scrape, republish or sell the cards or artwork, and do not reverse engineer or misuse the app.

Twirl is licensed to you under Apple's standardLicensed Application End User License Agreement (the "Apple EULA"), and these terms add to it. If the two conflict, the Apple EULA applies. Apple is not a party to these terms and is not responsible for the app or its content.

4. Free decks and Twirl Premium

Some decks are free. Twirl Premium unlocks every deck. Premium may be offered as an auto renewable subscription (for example weekly or yearly) and as a one time purchase. The products, prices and any free trial are shown in the app before you buy, in your local currency.

Auto renewable subscriptions

  • Payment is charged to your Apple Account when you confirm the purchase.
  • Your subscription renews automatically for the same period unless auto renew is turned off at least 24 hours before the end of the current period.
  • Your Apple Account is charged for renewal within the 24 hours before the end of the current period, at the price of the plan you chose. If the price changes, Apple will let you know beforehand as its rules require.
  • You can manage your subscription and turn off auto renew at any time in your device's Settings: tap your name, then Subscriptions. Cancelling stops future renewals; you keep Premium until the end of the period you paid for.
  • If you start a free trial, any unused portion of it is forfeited when you purchase a subscription. If you do not cancel at least 24 hours before the trial ends, it turns into a paid subscription.

Refunds and restoring purchases

All purchases are handled by Apple, so refunds are handled by Apple too: you can ask for one atreportaproblem.apple.com. If you reinstall the app or get a new device, use Restore Purchases in the app's settings with the same Apple Account.

5. Changes to the app

We keep improving Twirl, so decks, cards and features may be added, changed or retired over time. If we ever discontinue Premium, we will not charge further renewals and we will tell you in the app.

6. The website

Please do not try to disrupt the website or access it in automated ways that put a load on it.

7. No warranties

We work hard to make Twirl fun and reliable, but it is provided "as is" and "as available". To the extent the law allows, we do not promise that it will always be available, error free or right for every group, and we are not responsible for what players say or do during a game.

8. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you for any claim about Twirl is limited to the amount you paid for Twirl in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived, or liability that cannot be limited by law.

9. Ending these terms

You can stop using Twirl at any time by deleting the app (remember to cancel any subscription in Settings, since deleting the app does not cancel it). We may suspend access if you seriously break these terms.

10. Changes to these terms

We may update these terms, for example when we add features. We will update the effective date above and, for significant changes, let you know in the app or on the website. If you keep using Twirl after a change, the new terms apply.

11. Governing law

These terms are governed by the laws of the State of New Mexico, United States, without taking away any protection you have under the mandatory laws of the country where you live.
